Terms of sale
This translation is provided for information only. In the event of any discrepancy, the French version prevails.
1. Seller
These terms apply to sales concluded on www.neochauffe.fr between NéoChauffe, contact@neochauffe.fr (the “Seller”), and any natural person acting for non-professional purposes (the “Customer”).
2. Products
The essential characteristics of the products are presented on each product page. The Customer is invited to check that the kit is compatible with their radiator using the buying guide before ordering.
3. Prices
Prices are shown in euros. VAT not applicable, article 293 B of the French General Tax Code. Delivery costs are shown before the order is confirmed.
4. Ordering
The Customer selects their products, enters their details, chooses their delivery method and payment method, then confirms their order. A confirmation is sent to them by email. The Seller may refuse an order in the event of a previous dispute or an abnormal request.
5. Payment
Payment is made online, securely, at the time of ordering, using the methods offered at checkout.
6. Delivery
Products are delivered in France and in the European Union countries offered at checkout. Rates: France, standard delivery €10.99, free on orders of €79.99 or more; European Union €22. The order is delivered no later than 10 working days after it is confirmed.
In the event of a delay, the Customer may request delivery within a reasonable additional period. If delivery does not take place within that period, they may cancel the sale and obtain a refund of the amounts paid (articles L. 216-1 et seq. of the French Consumer Code). The product is the Customer's responsibility from the moment they receive it.
7. Right of withdrawal
The Customer has 14 days from receipt of their order to withdraw, without having to give a reason. To do so, they inform the Seller of their decision with a clear statement sent to contact@neochauffe.fr, for example using the model form available on the Returns page. They then return the product, complete, within 14 days of this statement. Return costs are paid by the Customer.
The Seller refunds all amounts paid, including the original delivery costs up to the standard rate, within 14 days of the statement. However, the Seller may wait until it has received the product back or proof that it has been sent. The Customer may be held liable for any loss in value of the product resulting from handling other than what is necessary to check its nature, characteristics and proper functioning.
8. Legal guarantees
The consumer has two years from delivery of the goods to obtain the application of the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer only has to establish the existence of the lack of conformity and not the date on which it appeared.
Where the contract for the sale of the goods provides for the continuous supply of digital content or a digital service for a period of more than two years, the legal guarantee applies to that digital content or digital service throughout the planned supply period. During this period, the consumer only has to establish the existence of the lack of conformity affecting the digital content or digital service and not the date on which it appeared.
The legal guarantee of conformity obliges the professional, where applicable, to provide all updates necessary to keep the goods in conformity.
The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of their request, free of charge and without major inconvenience to them.
If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.
If the consumer requests repair of the goods but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.
The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and obtain a full refund in exchange for returning the goods, if:
1° The professional refuses to repair or replace the goods;
2° The repair or replacement of the goods takes place after a period of thirty days;
3° The repair or replacement of the goods causes major inconvenience to the consumer, in particular where the consumer permanently bears the costs of taking back or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods;
4° The lack of conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.
The consumer is also entitled to a reduction in the price of the goods or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. The consumer is then not required to request repair or replacement of the goods first.
The consumer is not entitled to termination of the sale if the lack of conformity is minor.
Any period during which the goods are immobilised for repair or replacement suspends the remaining guarantee period until the goods are returned in working order.
The rights mentioned above result from the application of articles L. 217-1 to L. 217-32 of the French Consumer Code.
A seller who, in bad faith, obstructs the application of the legal guarantee of conformity is liable to a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (article L. 241-5 of the French Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for a period of two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept or to a full refund in exchange for returning the goods.
To make use of these guarantees, the Customer writes to contact@neochauffe.fr with their order number and a description of the defect. Return costs are then paid by the Seller.
9. Personal data
The processing of personal data is described in the Privacy policy.
10. Applicable law
These terms are governed by French law. The Customer may bring proceedings before the court of their place of residence.
